1. Agreement
These Terms of Service ("Terms") are an agreement between you and Kindsty Studios ("Kindsty," "we," "us," or "our") governing Liminality VR, its websites, game clients, accounts, community features, test builds, and related services (together, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old to use the Services. If you have not reached the age at which you can enter a binding agreement where you live, your parent or legal guardian must review and agree to these Terms for you and is responsible for your use. You may not use the Services if applicable law prohibits it.
3. Accounts and platform authentication
An eligible Meta or Steam account, platform entitlement, or another supported authentication method may be required. You must provide accurate information, keep your platform and device access secure, and notify us of suspected compromise. You may not sell, transfer, share, or impersonate an account, and you may not share authentication codes, session tickets, or other credentials.
Platform identities may be linked to one Liminality account to support automatic sign-in and cross-platform access. We may require an additional platform verification step before linking, unlinking, or changing an authentication method. You are responsible for platform fees, hardware, connectivity, and compliance with the platform provider’s terms.
4. Limited license
Subject to these Terms, Kindsty gives you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the game for non-commercial entertainment. The Services are licensed, not sold. Kindsty and its licensors retain all rights in the game, software, characters, art, audio, branding, code, and other content except for rights expressly granted here.
Mod or shader support, where a specific build expressly offers it, does not grant permission to redistribute protected game assets, bypass security, interfere with other users, access private systems, or use the Services commercially without written authorization.
5. Rules of conduct
You may not:
- Harass, threaten, stalk, exploit, discriminate against, or deliberately endanger another person.
- Share illegal, sexually exploitative, hateful, malicious, or privacy-invasive content, or expose another person’s private information.
- Cheat, automate play, falsify progression, duplicate or manipulate virtual items, evade a suspension, operate abusive bot accounts, or knowingly submit false reports or fabricated telemetry.
- Modify traffic or software to gain an unfair advantage; interfere with distributed authority, matchmaking, voice, authentication, moderation, or security; or attack, overload, scan, scrape, reverse engineer, or access systems except where applicable law expressly permits it.
- Impersonate staff, misuse LIMAS communications, falsely claim authority, or deceive players about safety, maintenance, enforcement, or account security.
- Use another person’s account or platform identity without authorization, or help anyone violate these Terms.
Competitive or security decisions may consider server records, signed backend events, consistency checks, session history, gameplay telemetry, reports, and human review. A disagreement among player-controlled clients is not, by itself, conclusive proof that the outlier cheated.
6. Voice, user content, and interactions
You remain responsible for what you say, create, upload, or transmit through the Services ("User Content"). You grant Kindsty a worldwide, non-exclusive, royalty-free license to host, transmit, reproduce, adapt for technical formatting, display, and moderate User Content only as reasonably needed to operate, secure, improve, and promote the Services. This license ends when the content is deleted from our active systems, except for lawful retention, backups, enforcement evidence, and content already shared publicly or with others.
Voice and online interactions may be heard or captured by other users. Do not communicate information you want to keep private. We may remove content or restrict communications that violate these Terms, but we do not guarantee that we will review every interaction.
7. Virtual items and purchases
Virtual currency, progression, cosmetics, and other virtual items are limited, revocable licenses to in-game functionality. They are not money, property, stored value, or redeemable for cash, and may not be sold or transferred outside an expressly supported feature. We may correct balances or reverse transactions caused by error, fraud, duplication, or rule violations.
Prices, taxes, refunds, and payment processing are governed by the store where a purchase occurs and applicable law. Steam and Meta editions may have different prices, features, or entitlements. Nothing in these Terms limits a mandatory consumer right.
8. Betas and test services
Beta access may require a role, invitation, compatible build, and an enabled beta-server setting. Beta features may be incomplete, unstable, reset, changed, or removed without notice. Do not rely on beta progression or availability. You may not bypass eligibility checks or distribute private builds, credentials, or confidential test material.
9. Availability and changes
We may patch, rebalance, restrict, suspend, or discontinue any part of the Services for maintenance, safety, legal, technical, or business reasons. Online, account, voice, and gameplay features are not guaranteed to be available continuously. Scheduled release dates are targets and may change. We may require updates and may prevent outdated or unsafe builds from connecting.
10. Moderation, suspension, and termination
We may warn, mute, remove, suspend, restrict, reset affected progression, or terminate access when we reasonably believe these Terms were violated or action is needed to protect users or the Services. Serious safety or security issues may require immediate action. We aim to use proportionate evidence and review, particularly for permanent bans, but we may limit details that would expose detection methods, another person’s information, or system security.
You may request review of an enforcement decision through an official support channel. Repeated, fraudulent, threatening, or abusive appeals may be closed. Termination ends the license in Section 4, but provisions that logically survive—including ownership, enforcement records, disclaimers, liability limits, and dispute terms—remain effective.
11. Third-party services
The Services depend on third parties such as Meta, Steam, Unity, brainCloud, Cloudflare, voice providers, and linked media services. Their services and terms are separate from ours. Kindsty is not responsible for third-party products, accounts, outages, content, or changes, except where applicable law says otherwise.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Liminality VR contains horror, darkness, flashing or intense visual effects, loud sounds, online voice, and user-generated interactions. Use appropriate VR safety settings, clear your play area, take breaks, and stop if you feel discomfort.
Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Kindsty and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, goodwill, profits, or access arising from the Services. Where liability cannot be excluded, our aggregate liability for claims relating to the Services will not exceed the greater of the amount you paid Kindsty for the Services during the 12 months before the claim or US $100.
These limits do not exclude liability that cannot lawfully be limited, including applicable rights for personal injury, intentional misconduct, fraud, or mandatory consumer protections.
14. Responsibility for claims
To the extent permitted by law, you agree to reimburse Kindsty for reasonable losses and costs resulting from your unlawful conduct, your material violation of these Terms, or your infringement of another person’s rights. This does not apply to losses caused by Kindsty or where consumer law prohibits this obligation.
15. Governing rules and disputes
Applicable law governs these Terms without depriving you of mandatory protections available where you live. Before filing a formal claim, you and Kindsty agree to make a reasonable, good-faith effort to resolve the issue by written notice. A dispute that cannot be resolved informally may be brought in a court with lawful jurisdiction. These Terms do not require individual arbitration and do not waive a right to participate in a class or representative action where that right applies.
16. General terms
If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a reorganization or transfer of the Services. These Terms and the Privacy Policy are the agreement between you and Kindsty about the Services, except for additional terms clearly presented for a feature or promotion.
17. Changes and contact
We may update these Terms as the Services change. We will post the new version and effective date and provide additional notice when required. Continuing to use the Services after an updated version becomes effective means you accept it, except where law requires another form of consent.
